The legal policy in Islam took into account the interest in preserving the purposes of the Sharia in its prohibition of same-sex marriage and the marriage of a Muslim woman to a non-Muslim; Because it builds on it important results, and religious and worldly purposes, of preserving the individual and society by preventing this evil, and accordingly, the study aimed to demonstrate the importance of the legal policy approach in controlling opinions related to this marriage, and rejecting human rights claims calling for same-sex marriage and for a Muslim woman to marry a non-Muslim, and to explain the sanctity of this Relationships, as the prohibition of this marriage is considered a protection for the family and the community in its religion and this world.
The study dealt with the legal policy and its evidence, conditions and fields, as well as the texts of the articles of international human rights conventions regarding the legalization of same-sex marriage and the marriage of a Muslim woman to a non-Muslim without any restriction. In his study, he indicated that Sharia policy is a safety valve in confronting laws and treaties that support and protect gay rights and the marriage of a Muslim woman to a non-Muslim woman.
